A provisional is a good way to lock in a filing date quickly, but it never becomes an issued patent by itself. To actually get a patent granted, you will need a non-provisional application that the USPTO examines.
Many founders now prefer to go straight to a non-provisional or upgrade quickly from provisional to non-provisional because:
- It starts the examination process sooner
- Can lead to an issued patent faster
- Creates a stronger "moat" story for investors
- Provides actual enforceable patent rights when granted
